to speak against this legislation. supervisors wiener and farrell, i guess supervisor farrell isn't here but you spoke forcefully in support of rent control earlier in the afternoon and yet your actions contradict your words because you're attempting to chip away at rent control right now. our largest source of affordable housing in it san francisco. supervisor kim, you had great questions earlier, questions about the ability of this legislation to withstand palmer lawsuits. regarding parkmerced, if people, who -- if the people who crafted the deal to make the garden apartments rent controlled in perpetuity or at least for the duration of the current tenant had not been so worried about the illegal weaknesses of the parkmerced deal there would have been no need to create the 200 million backup fund to protect tenants in case of court challenges and i imagine that 200 fund itself is probably on legal shaky ground. that could be challenged. so if the parkmerced development is on shaky legal ground i can only imagine this legislation is on equally shaky legal ground. there needs to be affor

and put money in the coffers which will help everyone. thank you, supervisors wiener and farrell for your proposal of balanced legislation. thanks for letting me speak too. >> chair wiener: thank you very much and thank you for being honest. next speaker. >> high there. i'm a san francisco resident for 13 years. i'm a t.i.c. owner and previous renter for many years. all of my co-owners in my six unit t.i.c. were once renters also. we are not opposed to rent control. i just wanted to make that clear. the lottery system is so outdated and overburdened and with the current backlog it may be over 10 years before being eligible for conversions. we're not trying to make a quick buck because our units have lost a significant amount of value since we purchased. we're previous renters who are looking to purchase a home to have stable housing in san francisco. we contribute to san francisco and we invest in san francisco. we are all moderate income households. we include a retired gm who is a renter for many years and wanted the security of owning his own home and t.i.c. was the only affordable opt

's been a long meeting, there's a lot of people behind me. i want to thank supervisors farrell and wiener for proposing this modest legislation to help t.i.c. owners while at the same time protecting renters. a little bit about me. i've lived in san francisco 35 years. i am not a speculator. i've been in my building for more than 20 of those years. i am not wealthy. i gave up a more lucrative career to work for a nonprofit so i don't make the money i used to. my co-owners of the t.i.c. are a young family with a newborn baby. they want to stay in san francisco. city hall talks a lot about keeping families in san francisco. but there's rarely legislation to do anything about that. this is legislation that will actually help families stay in san francisco. and i urge you to support it. thank you. >> chair wiener: thank you. next speaker. >> howdy. my name is ian -- of some disclosures. i own a two unit property in san francisco which is both my home and a rental property. a previous owner of the property i know created a covenant with san francisco which disallows division of the property in
buildings unless we do some kind of investigation. the protection in wiener and farrell's legislation for someone living in a t.i.c., we all know the lifetime leases are problematic under costa hawkins, but the other thing is it's very simple for a landlord of a t.i.c. to simply threaten or buy out that tenant and circumvent the lifetime lease. again there are no real protections for tenants. the only real protection for tenants against evictions for t.i.c.s is to not do t.i.c.s, period, end of discussion. let's provide homeowners other ways. we should be building. new construction is how we provide home ownership for middle income people. stop cannibalizing the rental stack. evicting one group of people to provide homes for others is not good policy. we should be together in demanding that this city provide affordable housing for everyone, and that we use new construction to provide condos for are people in the middle income level. thank you. >> chair wiener: thank you. next speaker. >> good afternoon. i'm marie coons from district 10, a t.i.c. owner. we bought our four unit building
here today. supervisor kim, thank you supervisor farrell thank you. -- again good afternoon my name is walker b ass.i am so pleased to be here is the nominee for the eastern neighborhood citizens advisory committee. i would like to thank supervisor cohen for her confidence in me and appreciate the chance to be with you to highlight a few of my qualifications. i have been a resident of homeowner in district 10 for seven years, a resident of the bay area for 12 years; like many transplant i have fallen in love with our city and have become an active member of our community by becoming engage in political matters in volunteering my time to support good causes. i worked in the clinton white house for three years working presidential personnel and making recommendations on, yes, political appointment in his administration. i have a decent understanding of the political process and the appointment process to be sure. my career in the bay area has been and is the development primarily in large companies now with ernst & young. i also started a food truck with friends. and i chose local v
introduced by supervisors farrell and wiener. this legislation will help my family and many other hundreds of first time homeowners in san francisco, while protecting tenants in raising an estimated 20 to 25 million in funds for affordable housing. we bought our two bedroom t.i.c. unit in october 2007. it was the only type of property we were able to afford at that time. now, the times have changed. five years and two kids later, we're in need of a different home. we tried selling our t.i.c. unit in september last year, and -- how initially attracted potential buyers were quickly turning away upon learning our unit was a t.i.c. we're not in it to make money. many buyers are afraid of t.i.c.s. and are willing to pay higher prices for the more familiar condominium type property. as most of our savings are locked in our property we feel very trapped and unable to move to a bigger house or a bigger apartment with two kids. if we were able to sell our t.i.c. property, we would be able to afford the bigger home in san francisco. by not allowing us to convert to condo, the city is not only losing
